As a healthcare and professional staffing company, we handle sensitive information with care and in accordance with applicable law. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website, apply for employment or placement, engage our staffing services as a client, or otherwise interact with us.

Please read this Policy carefully. By using our website or providing information to us, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with our practices, please do not use our website or submit information to us.

1.  Who This Policy Applies To

This Policy applies to the personal information of:

  • Applicants and candidates who apply for employment, placement, or assignment through us;
  • Employees and placed workers (including W-2 employees and independent contractors) whom we staff to client facilities;
  • Client and business contacts at healthcare facilities and other organizations that use our services; and
  • Website visitors who browse or interact with our website.

Where we act on behalf of a client facility (for example, when our placed workers access a facility’s systems), that facility’s own privacy notices and agreements may also apply.

2.  Information We Collect

2.1  Information You Provide to Us

We collect information you voluntarily provide, which may include:

  • Identifiers — name, email address, phone number, and mailing address;
  • Professional and employment information — resume or CV, employment history, references, professional licenses and certifications, education and credentials, work eligibility, and specialties;
  • Government and tax identifiers — Social Security number, date of birth, driver’s license or government ID, and work-authorization documentation (collected only when necessary for onboarding, payroll, tax, or credentialing);
  • Background and screening information — results of background checks, license verifications, and drug screening obtained through consumer reporting agencies (see Section 7);
  • Health-related credentialing information — immunization records, TB or other required screenings, and fitness-for-duty information required for placement at healthcare facilities (see Section 9);
  • Financial information — bank account details for payroll and benefits enrollment information;
  • Communications — information you submit through contact forms, employment applications, job inquiries, and correspondence with us.
2.2  Information Collected Automatically

When you visit our website, we may automatically collect certain information, including:

  • IP address and general location, browser type, and device information;
  • Pages visited, referring and exit pages, and the date and time of your visit;
  • Usage and interaction data collected through cookies and similar tracking technologies (see Section 10).
2.3  Information From Third Parties

We may receive information about you from job boards and recruiting platforms, references you provide, consumer reporting and credentialing agencies, and our client facilities in connection with your assignment or placement.

3.  How We Use Your Information

We use your information for legitimate business purposes, including to:

  • Respond to inquiries and requests;
  • Process and evaluate employment and placement applications;
  • Match candidates with staffing opportunities and client needs;
  • Verify professional credentials, licensure, education, and work eligibility;
  • Conduct background checks and screening where permitted by law;
  • Onboard, pay, and administer benefits for placed workers;
  • Communicate with you about available positions, assignments, and your relationship with us, including by phone, email, and text message (see Section 8);
  • Operate, maintain, secure, and improve our website and services;
  • Maintain business operations and records; and
  • Comply with legal, regulatory, tax, and contractual obligations, and enforce our agreements.

4.  How We Share Your Information

We may share your information with the following categories of recipients, only as needed for the purposes described in this Policy:

  • Client facilities and employers — healthcare facilities and other organizations for placement and assignment opportunities;
  • Screening and credentialing providers — background check, drug screening, and license verification vendors;
  • Payroll, benefits, and financial providers — to pay and administer benefits for our workforce;
  • Service providers — IT, hosting, communications, and other vendors who assist in operating our business under confidentiality obligations;
  • Affiliated entities — our affiliated companies where appropriate to provide services to you;
  • Government agencies and legal authorities — when required by law, subpoena, or legal process, or to protect our rights, safety, or property; and
  • Business transfers — in connection with a merger, acquisition, financing, or sale of assets, subject to appropriate protections.

 

We do not sell your personal information

We do not sell, rent, or trade your personal information to third parties for their own marketing purposes, and we do not “share” it for cross-context behavioral advertising as those terms are defined under applicable state privacy laws.

5.  Background Checks & Consumer Reports

As part of the placement process, and where permitted by law, we may obtain background checks, license verifications, and screening results through consumer reporting agencies. These reports are obtained in accordance with the federal Fair Credit Reporting Act (FCRA) and applicable state and local laws. Where required, we will provide you with a separate disclosure and obtain your authorization before procuring a consumer report, and we will follow applicable adverse-action procedures. Information obtained through screening is used only to evaluate suitability for employment or placement and is maintained confidentially.

6.  Communications & Text Messaging

With your consent where required, we may contact you by phone, email, and SMS/text message regarding your application, available positions, assignments, and related matters. Message and data rates may apply. You may opt out of text messages at any time by replying STOP to any message, and you may unsubscribe from marketing emails using the link provided in those emails. Opting out of promotional communications does not affect transactional or employment-related messages necessary to your relationship with us.

7.  Healthcare Information & HIPAA

Elevation Staffing Services supports compliance with the Health Insurance Portability and Accountability Act (HIPAA) and applicable state health-privacy laws. It is important to understand the distinction between the categories of health-related information we handle:

  • Applicant and employee information that we collect for hiring, credentialing, and placement — including immunization and screening records — is generally treated as confidential employment information under the Americans with Disabilities Act (ADA) and state law, rather than as HIPAA Protected Health Information (PHI). We store such information securely and limit access to those with a legitimate need.
  • Protected Health Information (PHI) that our placed workforce may access during an assignment belongs to the client healthcare facility. Such PHI is handled in accordance with the facility’s policies, applicable Business Associate Agreements, and federal and state privacy laws. We do not use client PHI for our own purposes.

Where Elevation Staffing acts as a Business Associate of a covered entity, we handle PHI in accordance with the terms of the applicable Business Associate Agreement and HIPAA.

8.  Cookies & Tracking Technologies

Our website uses cookies and similar technologies to enable core functionality, remember your preferences, analyze website traffic, and improve site performance. Cookies we use may include strictly necessary cookies, performance and analytics cookies, and functional cookies. You may disable cookies through your browser settings; however, some features of the website may not function properly without them.

Do Not Track. Some browsers offer a “Do Not Track” signal. Because there is no common industry standard for responding to these signals, our website does not currently respond to them. We will update this Policy if that changes.

9.  Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Policy, including to provide staffing services, maintain employment and payroll records, and comply with our legal, tax, regulatory, and contractual obligations. Retention periods vary by the type of information and the applicable legal requirements. When information is no longer needed, we take reasonable steps to securely delete, de-identify, or archive it.

10.  Data Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect your personal information from unauthorized access, disclosure, alteration, or destruction. Access to sensitive information is limited to authorized personnel with a legitimate business need. While we strive to use commercially acceptable means to protect your information, no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security.

11.  Your Privacy Rights

Depending on where you live and applicable law, you may have some or all of the following rights regarding your personal information:

  • Request access to, or a copy of, the personal information we hold about you;
  • Request correction of inaccurate or incomplete information;
  • Request deletion of your personal information, where permitted by law;
  • Opt out of certain communications or, where applicable, the sale or sharing of personal information (note: we do not sell or share personal information);
  • Withdraw consent where we rely on it; and
  • Ask questions about how your information is collected, used, and shared.

To exercise any of these rights, please contact us using the information in Section 15. We will verify your request and respond within the timeframes required by applicable law. We will not discriminate or retaliate against you for exercising your privacy rights.

11.1  California Residents (CCPA/CPRA)

If you are a California resident, the California Consumer Privacy Act, as amended, provides additional rights, including the right to know the categories and specific pieces of personal information we collect, use, and disclose; the right to request deletion and correction; the right to opt out of the sale or sharing of personal information; and the right to limit the use of sensitive personal information. We do not sell or share personal information as those terms are defined under California law. You may designate an authorized agent to make a request on your behalf. We will not discriminate against you for exercising these rights.

11.2  Other U.S. State Privacy Rights

Residents of certain other states — including Connecticut, Virginia, Colorado, and others with comprehensive privacy laws — may have similar rights to access, correct, delete, and obtain a copy of their personal information, and to appeal a denied request. Contact us to exercise these rights, and we will honor them as required by the applicable state law.

Our website and services are intended for individuals who are at least 18 years old and eligible to work. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us so we can take appropriate action.
